Discussion: Reply letter to the State Auditor

Commissioners discussed a response letter from the state auditor, which addressed several areas where the state found county funds spent on mitigation activities exceeded allowable limits. In addition to a clerical error, the state auditor also identified expenditures from tourism promotion funds that were deemed unallowable including the Trail Ambassador program, Moab Arttrails, and some advertising. The commissioners expressed disagreement with the finding regarding the trail ambassador program. The commissioners acknowledged the need to address the state auditor’s findings to avoid potential penalties, such as the withholding of TRT funds. The commission agreed to include an action item on the upcoming Friday Dec. 6 special meeting agenda to formally accept the state auditor’s findings, with the possibility of further discussion during a budget workshop scheduled for Monday, Dec. 9.

Public Hearing: Kane Creek Zoning Appeal Hearing 

A zoning appeal hearing for a controversial property owned by Kane Creek Preservation and Development. The appeal was initiated by Kane Creek Development Watch, a local community group, who contested the highway commercial zoning designation for a portion of the property where Kane Creek intends to develop a large-scale resort. No decision was made; discussion will continue on Friday, December 6.

Public Hearing: Adopting Ordinance Approving Land Use Code Revisions to Articles 8 and 9 Subdivision Review Processes 

The commission held a public hearing to consider adopting an ordinance revising the land use code in accordance with state mandates to enhance subdivision review processes. The proposed revisions included modifications to the review process timeframes, the number of review cycles, and communication protocols with applicants.

Public Hearing: Adopting an Ordinance to Approve the Repeal and Replacement of Section 6, Land Use, of the 2030 General Plan and the Future Land Use Map of Spanish Valley of the 2030 General Plan 

In this public hearing, the focus was on the proposed repeal and replacement of the land use section and future land use map in the 2030 General Plan. Revisions included changes to the language and format, the introduction of place types, and considerations of issues like short-term rentals, second homes, and the challenges in the housing market.

Woytek explained his conservative approach to revenue projections for the 2024 amendment, emphasizing the need to avoid exceeding the budget.

Public Hearing: Soliciting Comments on the Proposed Cost of Living Adjustment for All Elected Officials and an Increase to the Wages of the Assessor, Recorder, Treasurer, Clerk, Auditor, and Surveyor

Special Events Grant Awards

The Economic Development Department presented the remainder of the special event grant awards proposed by the Travel Council Advisory Board for the 2024 grant round. Grand funding was awarded to Dead Horse Ultra ($5,000), From a Woman ($5,500), Moab Arts Festival ($10,000), Moab Canyons Endurance Ride ($6,000), Moab Folk Festival ($5,000), Moab Free Concert Series ($13,400), Moab Music Festival ($5,000), Phoenix Experience ($5,000), Rotary Club Car Show ($5,000), YGP Harvest Festival ($3,125).
